Terms of Use



Payment Terms/Establishing Credit

Payment by credit card or PayPal is encouraged. Your card will be billed at the time you place your order. All major credit cards are accepted.

If you are purchasing custom items or desire to establish credit terms, you must submit to us satisfactory credit references and banking account information. Once your credit is established, our terms of sale are NET 30 days from the date of shipment as shown on our invoice to you. Overdue accounts will be subject to a 1.5% per month interest charge on the unpaid amount including interest. We may cancel or change credit terms at our discretion including requesting advance payment at the time you place your order. Taxes
All amounts due for sales, use, excise and other similar taxes will be added to your invoice and are your responsibility unless you have supplied us with a current exemption certificate.

Shipping - Custom Orders
We will endeavor to use direct and economical carriers and routes available to ship your order. Our shipping charges are F.O.B. point of manufacture and include handling. Our shipping charges are prepaid and added to your invoice. If you have special shipping requirements such as inside delivery or if there are special shipping charges such as fuel surcharges, these additional charges may be invoiced separately to you.

Shipping - Stock Orders
Free shipping to addresses in the continental 48 states for all stock orders placed at web prices using Standard UPS Ground Shipping. Shipping charges will apply to expedited stock orders, stock orders shipping outside the continental 48 states, and special orders for stock products not included on our website.

Freight Claims
If your product is damaged in transit or does not arrive in whole or in part, we will make sure that your order is completely satisfied. We will require that you prepare a claim with the carrier and will assist you in making this claim. Since all the proceeds from this claim will go to you, you will be responsible for payment on the replacement product.

Returns
Before returning any product to us, you must notify one of our customer service representatives by calling 800-225-4805 or email sales@colortrieve.com to describe why you are returning the product and obtain a Return Authorization Number and return shipping address. You will be responsible for all return shipping and handling charges and a restocking charge will be applied to your return credit (restocking fee percentage varies per product). We will provide you with a full credit for all products that you return as a result of our mistake or that are defective. In general, you may not return any custom products made specifically for you or any products that you have not returned within forty five (45) days from the original date of shipment to you. Cancellations/Change Orders
Once you have placed your order, you may not cancel or change your order without our written authorization. You will be charged for any cost of making changes to your order or for any cancellation costs.

ADDITIONAL TERMS FOR CUSTOM ORDERS

Quotations
In order to obtain pricing for a custom product, you will need to provide detailed product specifications. Please call (800) 225-4805 or email sales@colortrieve.com. It is always best to submit a sample but if one is not available, you should sketch or mock-up a sample with notations as to quantity, size, color, copy etc. Verbal specifications may suffice for simple custom products or stock items with minor custom changes. Based on these specifications, we will provide you with a price quote which will be good for forty-five (45) days. After that date, a new price quote will be required.

Lead Times
As part of our quotation, we will provide you with an estimate of lead times for fulfillment of your order. Firm delivery dates will be determined after we receive your order and after you have approved any artwork for your order. Delivery refers to the date your order is shipped from the manufacturer and does not include the time it takes for the shipped product to get to you.

Artwork
If your product includes custom printing, you are generally asked to furnish camera ready artwork in an EPS file. We can also provide artwork for you and will provide you with our estimated cost upon receiving from you a detailed description or sample of the copy. We will provide you with a proof of the artwork for your approval. Our stated lead times for your order begin when we receive your approval of the artwork.

Pre-Production Proofs
In order to insure that the correct products are being specified and produced for your new custom order, we will generally provide you with a mock-up proof for your approval. Our stated lead times for your order begin when we receive your approval of the artwork.

Hold and Release and Drop Shipping
Hold and release services are available. You can place a blanket order and have us ship on predefined dates or as requested. All products must be shipped within a twelve (12) month period. You agree to accept shipment from us of any inventory held beyond that period at your expense. We reserve the right to dispose of any inventory held beyond that period at your expense. For your product being held, you will have the ownership and risk of loss. Drop shipment to any location in the United States is available at your request and expense.

The entire content included in this site is copyrighted as a collective work under the United States and other copyright laws and is the property of Colortrieve Systems Inc. Permission is granted to electronically copy and print hard copy portions of this site for the sole purpose of placing an order with Colortrieve or purchasing products from Colortrieve. Any other use, including but not limited to reproduction, distribution, display or transmission of the content of this site is strictly prohibited, unless authorized in advance by Colortrieve.

Typographical Errors
In the event that a product is mistakenly listed at an incorrect price or with incorrect specifications, Colortrieve reserves the right to refuse or cancel any orders placed for that product, whether or not the order has been confirmed and your credit card charged. If your credit card has been charged, Colortrieve will promptly issue a credit to your card in the amount that had been charged.

Use of Site
Harassment in any manner or form on the site including via email, text, chat, or otherwise, is strictly forbidden. The use of obscene or abusive language is also strictly forbidden. This site may not used to upload, distribute, or otherwise publish any content without the prior authorization of Colortrieve. This site may not be used to solicit others to join or become members of any other commercial online service or other organization without the prior authorization of Colortrieve. Finally, Colortrieve does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials.

Third Party Links
Colortrieve may link to sites operated by third parties. Colortrieve has no control over these linked sites which will have separate privacy and data collection policies. These linked sites are only for our users convenience and are to be used at their risk. Nonetheless, Colortrieve seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but also for sites it links to as well (including if a specific link does not work).

Miscellaneous
The use of this site is governed in all respects by the laws of the Commonwealth of Massachusetts, without regard to choice of law provisions. Failure by Colortrieve to enforce any provision of these terms and conditions shall not be construed as a waiver of any provision or right.

PRIVACY

We respect your privacy. We have procedures in place to protect your credit and billing information. We do not make our customer list available to other companies.
